1. Acceptance and Approval

By accessing or using the Vistark platform (“Platform”), you accept the following terms of use (“Terms”) and the accompanying Privacy Policy and Terms & Conditions documents. If you do not accept these Terms, please refrain from using the Platform.

2. Account Creation

  You must be 18 years of age or older to become a member of the Platform.
• •
  You are responsible for the accuracy and timeliness of your membership information.
• •
  You must not share your account information with third parties and you must keep your password secure.
• •
  You are responsible for all transactions made through your account.
• •
  Architect accounts are subject to document verification (diploma and optional certificate upload). You agree that the documents you upload are authentic; providing false documents may result in account closure and legal action.

3. Rules of Use

  Legal Use: You may only use the Platform for purposes in accordance with the law and public order.
• •
  Harmful Behavior: Collecting content with automated tools, unauthorized access to systems, and behaviors that disrupt the operation of the platform are strictly prohibited.
• •
  Community Guidelines: It is essential to treat other users with respect and not share hate speech, harassment, profanity, discrimination, or misleading content.

4. Content and Intellectual Property

  You declare that you own or have the right to use the copyrights of the visual, text, and project files you upload to the Platform.
• •
  By uploading content, you grant Vistark a limited, non-exclusive, worldwide license to store, display, and process your content solely for operating the Platform and providing the services you requested.
• •
  All rights of the logo, brand, interface, and software on the Platform belong to Vistark; unauthorized use, reproduction, or distribution is prohibited.
• •
  If you believe your copyrighted work has been posted on the Platform without authorization, contact us at info@vistark.net with a takedown request; we will review it and remove infringing content promptly.

5. Payment, Subscriptions and Refunds

  Some features are covered by a paid subscription. Current prices are clearly stated in the payment step.
• •
  Payments are collected securely via PayTR infrastructure. Your card information is not stored by the Platform.
• •
  You can cancel your subscription at any time; your service access continues until the end of the paid period. If your subscription renews automatically, you will be notified before each renewal and can cancel before the renewal date.

  As a consumer, you have the right to withdraw from a distance contract within 14 days of concluding it under the Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği). For digital services, this right does not apply once the service has begun with your explicit consent and acknowledgment that you lose the right of withdrawal upon full performance.

  In the event of a valid withdrawal, or when a registration payment is invalidated by document rejection as described in the registration flow, fees paid will be refunded in full to the original payment method within 14 days.

6. Continuity of Service

The Platform makes reasonable efforts to provide uninterrupted and error-free services, but you acknowledge that there may be interruptions due to maintenance, updates, and force majeure. Vistark cannot be held responsible for any damages arising from these interruptions.

7. Termination

  If behaviors contrary to these Terms, applicable law, or third-party rights are detected, we may suspend or close your account.

  You can delete your account from settings at any time; if you have an active subscription, you must cancel it first.
• •
  After termination, your access to the Platform ends and your personal data is deleted within the periods specified in the Privacy Policy.

8. Limitation of Liability

Vistark is not responsible for consequences such as indirect damages, loss of profit, loss of data, or loss of business to the maximum extent permitted by law. The Platform acts as an intermediary between project owners and architects and is not a party to any contract concluded between users. Nothing in these Terms limits liability that cannot be limited under mandatory provisions of applicable law, including Law No. 6502 on the Protection of Consumers.

9. Changes

These Terms may be updated from time to time. You will be informed of important changes by e-mail or an announcement will be made on the Platform. Continuing to use the Platform after the change means you accept the updated Terms.

10. Contact and Competent Court

For your questions about these Terms, you can contact us through our contact page or at info@vistark.net. These Terms are subject to the laws of the Republic of Turkey and Istanbul (Central) Courts and Enforcement Offices are authorized for disputes. If you are a consumer, the mandatory provisions of Law No. 6502 apply, and you may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or the Consumer Courts in accordance with the law.
